This Unit introduces students to the principles and foundations of equity as an essential aspect of the Common Law tradition with emphasis on the law of trusts. The unit covers the following topics: origins and history of the equitable jurisdiction; the relationship between equity and common law; basic concepts of equity; priorities; an introduction to trusts; express or declared trusts; charitable trusts; the complete constitution of a voluntary trust; the appointment of trustees, the powers and duties of trustees and the rights and responsibilities of beneficiaries, the writing requirements for certain transactions; constructive trusts; the principles of tracing; fiduciary duties; remedies for breach of trust; relief of trustees; unconscionable dealings and remedies |
