Unit Overview:
This unit examines the competition law provisions of the Competition and Consumer Act 2010 (Cth) (“CCA”). The unit considers the policy framework behind the law, including Australia’s National Competition Policy, and the current policy debates surrounding the regulation of competition. Throughout the unit, considerable time will be spent on reading and interpreting statures and on the administration of schemes of government regulation. This unit will cover the following topics: The restraint of trade doctrine The goals of competition law. The economics of competition law Cartels and other anti-competitive agreements Exclusive dealing Misuse of market power Resale price maintenance Mergers and acquisition Access to essential facilities Authorization and notification Enforcement, penalties and remedies
