Business Law involves a detailed study of the law of contract, torts and consumer law which is the foundation of the common law system. The objective of this unit is to equip students with a broad understanding of these basic principles which apply to many commercial situations encountered in the business world.The unit will focus on relevant cases and legislation. Central to this will be coverage of the Australian legal system, the elements of formation of contracts, terms of a contract, matters affecting consent to a contract, discharge of contracts, illegality, remedies, and third party rights. E-commerce and contract law is also considered as well as the Australian Consumer Law (ACL). Finally, the basic principles of tort law as it relates to business will also be covered.Importantly, the unit will:(a) Develop students’ ability to analyse factual situations and correctly identify the relevant principles of contract law that are applicable to the resolution of problems raised by such situations. (b) Provide basic training in contract drafting techniques that will expose them to some of the important skills that will be further refined and developed in later professional life. |
